There were two casual vacancies between the 2001 and 2004 Legislative Assembly elections.

Mr Gary Humphries resigned from the Legislative Assembly on 24 January 2003. On 10 February 2003, Ms Jacqui Burke, Liberal Party, was declared elected to fill the casual vacancy following a recount of ballot papers received by Mr Humphries at the 2001 election.

Ms Kerrie Tucker resigned from the Legislative Assembly on 14 September 2004. As the 2004 pre-election period had begun, the casual vacancy was not filled under section 197 of the Electoral Act 1992.

Mr Gary Humphries

Former Chief Minister, Mr Gary Humphries resigned from the Legislative Assembly on 24 January 2003. A notice was published in the Canberra Times on 28 January 2003 calling for nominations from eligible candidates. At the close of applications on 7 February 2003, a total of 8 nominations had been received. In a recount of ballot papers received by Mr Humphries at the 2001 election, Ms Jacqui Burke, Liberal Party, received more than half the votes. On 10 February 2003, Ms Burke was officially declared elected to fill the casual vacancy.
